The Role and Recognition of Lawyers in Tunisia
A lawyer in Tunisia is a legal professional whose traditional role is to advise, represent, and defend clients—whether individuals or legal entities—before the courts, advocating for and protecting their rights.
In recognition of the essential role played by lawyers in the defense of freedoms and the rule of law, the Constitution of the Tunisian Republic of January 27, 2014 granted the legal profession a prominent and respected status within the national legal system.
Regulation and Independence of the Legal Profession
The legal profession is no longer regarded merely as an auxiliary of justice, but rather as a true partner in the administration of justice.
In Tunisia, the profession is regulated by Decree-Law No. 79-2011 of August 20, 2011 on the organization of the legal profession. Article 1 of this decree-law defines the profession as a liberal and independent profession that contributes to the administration of justice and defends freedoms and human rights.
Main Responsibilities of a Lawyer
According to Article 2 of this Decree-Law, a lawyer is exclusively entrusted with the mission of representing parties, regardless of their legal status, defending, assisting, and advising them, and conducting on their behalf all proceedings before courts and judicial, administrative, disciplinary, and regulatory bodies, as well as before the judicial police, in accordance with the legislative provisions governing civil, commercial, tax, and criminal procedures.
Lawyers are also authorized to draft company incorporation documents and handle capital increases or reductions whenever such transactions involve contributions of real estate assets or business goodwill.
Drafting Legal Documents and Legal Instruments
Article 105 of the Constitution provides that the legal profession is free and independent. It contributes to the establishment of justice and the protection of rights and freedoms. It benefits from legal guarantees that ensure its protection and enable it to properly perform its duties. It is no longer considered a mere auxiliary of justice but a true partner in the administration of justice.
