Importation of a Means of Transport Every Ten Years:

Tunisians residing abroad who are planning a definitive return to Tunisia are entitled to import their personal belongings and household effects, as well as one passenger vehicle, a light commercial vehicle (up to 3.5 tons), or a motorcycle. This privilege must be exercised within a maximum period of two years following their definitive return to Tunisia.

Indeed, the beneficiary of this benefit is entitled to choose to import:

  • Either a vehicle with full exemption from customs duties, which will be registered under the Tunisian “RS” license plate series.
  • Or a vehicle with partial exemption from customs duties, subject to payment of customs duties amounting to 25% or 30% of the vehicle’s value, which will be registered under the standard Tunisian license plate series.

Tax Advantages in Tunisia

Tunisian legislation provides certain tax advantages and fiscal privileges for Tunisians living abroad.

Acquisition of Real Estate by Non-Residents, Regardless of Nationality:

The acquisition of built real estate by non-residents intended for residential use or for the exercise of an economic activity is subject to registration with the tax authorities at a fixed fee of 30 Tunisian dinars per page, regardless of the sale price. The purchase price must be paid in a convertible foreign currency.

The buyer is only required to pay the property transfer tax (CPF), which amounts to 1% of the sale price.

This privilege is granted to all non-resident individuals, regardless of nationality, provided that they have held non-resident status for the two years preceding the signing of the sales contract.

A non-resident, within the meaning of Tunisian tax law, is defined as any individual whose habitual residence is abroad and who has spent at least 183 days, continuously or discontinuously, outside Tunisia during the civil year.

Required Conditions:

It is noted that, in order to benefit from this right, the following conditions must be met:

  • The beneficiary must be of Tunisian nationality and have reached the age of majority (18 years) on the date of definitive return to Tunisia (this condition does not apply to married Tunisian women).
  • The beneficiary must not have already benefited from this regime within the past ten years. Indeed, under the 2024 Finance Law, it is now possible to benefit from this right once every ten years.
  • The beneficiary must have resided abroad prior to the date of the last entry into Tunisia for at least two years, without exceeding 120 days spent in Tunisia during each 365-day period.

Who is authorized to drive the imported vehicle?

The persons authorized to drive this vehicle, in addition to the beneficiary, are as follows:

  • The beneficiary’s spouse.
  • The beneficiary’s ascendants, descendants, and siblings: these individuals are authorized to drive the vehicle subject to prior authorization issued by the customs authorities. This authorization is granted on an annual basis and is renewable each year.
  • It should be noted that any person driving the vehicle in the presence of the beneficiary or the beneficiary’s spouse on board does not require prior authorization.

IMPORTANT NOTICE: WHAT YOU NEED TO KNOW ABOUT THE IMPORT AND EXPORT OF FOREIGN CURRENCY IN TUNISIA:

Following issues have been encountered by travelers with customs services regarding the import and export of foreign currency. It is therefore essential to be aware of the foreign exchange regulations in Tunisia in order to avoid potential customs fines or legal proceedings.

For the import of foreign currency:

If the amount of foreign currency imported exceeds 20,000 Tunisian dinars, a mandatory customs declaration must be made upon entry or exit.

Failure to declare this amount will result in:

  • Confiscation of the undeclared funds
  • Preparation of a customs report (official statement/protocol)
  • Payment of a fine that may reach up to five times the amount confiscated

For the export of foreign currency:

For non-resident travelers departing Tunisia, any re-export of remaining foreign currency in cash exceeding 5,000 Tunisian dinars and up to 30,000 Tunisian dinars must be supported at exit by a currency import declaration previously completed upon entry into the country and endorsed by customs authorities.

Above 30,000 Tunisian dinars, the re-export of currency must be carried out via bank transfer through an authorized financial institution.

In the absence of such a declaration, the traveler risks:

  • Confiscation of the undeclared amount
  • Establishment of a customs report (official record)
  • Payment of a fine that may reach up to five times the confiscated amount

Importance of the Currency Import Declaration:

The currency import declaration is important because it allows non-residents to open a foreign currency account and subsequently re-export any remaining amount. This document is therefore the only legal proof of the origin of the funds.

It is recommended to complete a currency declaration even if the amount is below 20,000 Tunisian dinars, in order to ensure the smooth re-export of any remaining balance that may exceed 5,000 Tunisian dinars.

The currency import declaration is a crucial document that can help you avoid many inconveniences and legal complications.

Validity of the Currency Import Declaration

It should be noted that the currency import declaration is valid for three months only, starting from the date of entry of the non-resident traveler.
